"Platform" refers to the website, mobile application, and all online services operated by GiftGlobal India.

"User", "you", or "your" refers to any individual who accesses, browses, or makes a purchase on the Platform.

"Products" refers to all garments, apparel, accessories, and related items listed for sale on the Platform.

"Order" refers to a confirmed request by you to purchase Products from the Platform.

By using our Platform, you acknowledge that you have read, understood, and agreed to these Terms, along with our Privacy Policy, Returns & Refund Policy, and Shipping Policy, which are incorporated herein by reference.

If you do not agree with any part of these Terms, you must not access or use the Platform. Your continued use of the Platform constitutes your acceptance of any updates or modifications to these Terms.

You must be at least 18 years of age or have the legal capacity to enter into binding contracts under applicable Indian law to create an account and make purchases on the Platform.

When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that are found to be fraudulent, abusive, or in violation of these Terms.

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Platform in any manner that violates applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Platform, its systems, or networks.
• Interfere with or disrupt the Platform's servers, networks, or services.
• Use automated systems, bots, or scrapers to access or collect data from the Platform.
• Post or transmit any content that is defamatory, obscene, fraudulent, or infringes upon intellectual property rights.
• Manipulate prices, reviews, or ratings in any deceptive manner.

All Products displayed on the Platform are subject to availability. We reserve the right to limit quantities, refuse orders, or discontinue any Product at any time without prior notice.

Prices for Products are listed in Indian Rupees (₹) unless otherwise stated and are inclusive of applicable taxes where required. Prices may change without prior notice. The price confirmed at the time of placing your Order is the price that will apply.

We strive to display Product colors and images as accurately as possible. However, actual colors may vary slightly due to monitor settings, photography, or manufacturing variations.

Placing an Order on the Platform constitutes an offer to purchase the selected Products. An Order is confirmed only when we accept it by sending an Order confirmation email to your registered email address.

We reserve the right to accept or decline any Order, in whole or in part, at our sole discretion. If we are unable to fulfill your Order, we will notify you and process a full refund for any amount already charged.

Cancellation of an Order by you is subject to our cancellation policy as detailed in our Returns & Refund Policy. Orders that have been dispatched cannot be cancelled but may be returned in accordance with our Return Policy.

We accept payments through various methods including credit cards, debit cards, UPI, net banking, digital wallets, and cash on delivery (where available). All payments are processed through secure third-party payment gateways.

By submitting payment information, you authorize us and our payment partners to charge the designated payment method for the total Order amount, including shipping charges and applicable taxes.

If a payment fails or is declined, your Order will not be processed. We are not responsible for any charges levied by your bank or financial institution related to failed or disputed transactions.

Delivery of Products is subject to our Shipping Policy, which forms an integral part of these Terms. Estimated delivery timelines are provided at the time of placing an Order and may vary based on location, availability, and courier partner.

Title and risk of loss for Products pass to you upon delivery to the designated shipping address. It is your responsibility to ensure that the delivery address is accurate and complete.

We offer returns and refunds in accordance with our Returns & Refund Policy. Please refer to the detailed policy for information on return eligibility, windows, processes, and refund timelines.

Products must be returned in their original condition with all tags, packaging, and accessories intact. We reserve the right to reject returns that do not meet these conditions.

All content on the Platform, including but not limited to text, graphics, logos, images, designs, software, and compilation of data, is the exclusive property of GiftGlobal India or its licensors and is protected under Indian and international intellectual property laws.

You may not reproduce, distribute, modify, display, or otherwise use any content from the Platform without our prior written consent, except for personal, non-commercial use.

Product images, descriptions, and reviews submitted by users remain the intellectual property of the respective owners. By posting content on our Platform, you grant us a non-exclusive, royalty-free license to use such content for Platform operations and marketing purposes.

You agree not to engage in any activity that harms, disrupts, or interferes with the Platform or the experience of other users. Prohibited activities include, but are not limited to:

• Submitting false, misleading, or fraudulent information.
• Posting abusive, defamatory, or harassing reviews or content.
• Creating multiple accounts to manipulate the Platform.
• Engaging in fraudulent payment activities or chargeback abuse.
• Reselling or commercially exploiting Products purchased from the Platform without authorization.

You may submit reviews and ratings for Products purchased on the Platform. Reviews must be honest, accurate, and based on your genuine experience. We reserve the right to moderate, edit, or remove reviews that violate our content guidelines.

By posting a review, you grant us the right to display, reproduce, and distribute the review on the Platform and in marketing materials. You agree not to post content that infringes upon the rights of any third party.

Products sold on the Platform are warranted against manufacturing defects for the period specified in the Product description or as required by applicable law. Warranty claims are subject to our Returns & Refund Policy.

The Platform and its content are provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

To the maximum extent permitted by applicable law, GiftGlobal India, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Platform, including but not limited to loss of profits, data, goodwill, or other intangible losses.

Our total liability for any claim arising from or related to your use of the Platform or purchase of Products shall not exceed the total amount paid by you for the relevant Product or Order.

You agree to indemnify, defend, and hold harmless GiftGlobal India, its directors, officers, employees, affiliates, and agents from and against any claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

• Your breach of these Terms or any policy referenced herein.
• Your violation of any law or the rights of any third party.
• Your use of the Platform or any content posted by you.
• Any fraudulent or unlawful activity conducted through your account.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. The courts of New Delhi, India shall have exclusive jurisdiction over any disputes arising from or related to these Terms or the Platform.

Before initiating legal proceedings, parties shall attempt to resolve disputes amicably through good-faith negotiations. If the dispute cannot be resolved within 30 days, either party may initiate legal proceedings.

Any arbitration or legal proceedings shall be conducted in English and governed by the Arbitration and Conciliation Act, 1996 (India), where applicable.

We reserve the right to modify or update these Terms at any time at our sole discretion. Any changes will be effective immediately upon posting the updated Terms on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

It is your responsibility to review these Terms periodically for updates. We will make reasonable efforts to notify users of significant changes, but such notification is not guaranteed.

We may suspend or terminate your access to the Platform at any time, without prior notice, if we believe you have violated these Terms or any applicable law. Upon termination, all provisions of these Terms that by their nature should survive termination shall remain in effect.

You may close your account at any time by contacting our customer support. Any pending Orders or obligations will be fulfilled prior to account closure.
